Coronavirus (COVID-19) Alert

All pending eviction orders are suspended until further notice, as ordered by Chief Administrative Judge Marks.  No tenant may be evicted until there is a change to the court order.  Under new state legislation, if you have experienced a financial hardship any time between March 7, 2020 and the date that all COVID-related safety restrictions are lifted in the region, you may not be evicted for failing to pay rent first owed during that period.

New York City Housing Court is currently open for emergency cases permitted by the court, including if you are locked out of your home without a court order, if you need emergency repairs, or if you need critical services like heat or hot water. Emergency cases can be started electronically or over the phone and you can appear without coming to a court building.

NYC Housing Court is accepting new eviction filings effective June 20, 2020, for issues other than non-payments. Landlords will only be permitted to file new eviction cases by mailing in to the housing court.  Tenants who are served with papers for an eviction case do not need to visit the courthouse to respond.  Nevertheless, unrepresented landlords or tenants who come to the courthouse to file a case or answer will be assisted.

Your landlord can still collect rent as scheduled; there is no rent suspension at this time.

The only legal way a landlord or building owner may evict a tenant who refuses to move voluntarily is through an eviction proceeding in Housing Court.
